13.2.2.2 SMS Services Schedule.

This SMS Services Schedule forms part of the Email and SMS Marketing Services Agreement. It applies only when SMS Services are selected in the applicable Statement of Work or Order.

5. SMS Services Schedule

5.1 Activation. This schedule applies only when SMS Services are selected in an SOW. Sun Locke will not send SMS marketing or automated messages for Client unless the SOW identifies the sending platform, sender identity, approved use case, and implementation responsibilities.

5.2 Consent records. Client is responsible for obtaining and preserving the legally required consent for each intended recipient and use case. Consent records must identify the sender, message purpose, phone number, disclosure language, and any other information reasonably required by the applicable law, platform, carrier, or messaging registry.

5.3 Opt out and frequency. Sun Locke will configure reasonable opt out handling for supported keywords and platform controls, including STOP, CANCEL, END, UNSUBSCRIBE, and equivalent requests where supported. Client must not interfere with suppression, send outside approved windows, or use SMS for a purpose that was not covered by the applicable consent and SOW.

5.4 Platform and carrier decisions. Delivery may be affected by carriers, registration requirements, filtering, platform rules, number reputation, recipient settings, or events outside Sun Locke’s control. Sun Locke may pause sending when a platform, carrier, regulator, or reasonable compliance review identifies a material risk.
